The nationwide injunction regarding enforcement of the BOI filing requirements, announced in early December 2024 – was lifted by a three-judge panel of the U.S. Court of Appeals for the Fifth Circuit on December 23, 2024. Three days later, on December 26, 2024 – the Fifth Circuit Court of Appeals reversed its own three-judge panel and reinstated the stay.

Therefore, reporting companies are not presently required to file their beneficial ownership information and will not be liable if they fail to do so.

Your firm’s access, as well as your client’s access to the PathQuest BOI platform – continue to remain active. Until further guidance is provided, actual payment for reports and filing with FinCEN is suspended.

During this period of uncertainty, support will be limited to the PathQuest BOI knowledgebase and our chatbot.
